Welcome to Arsenal Computing. These terms and conditions ("Terms") govern your use of our website, software, products, and services (collectively, "Services"). By using our Services, you agree to these Terms. If you do not agree to these Terms, you may not use our Services.

1. Use of Our Services

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to use our Services:

2. Intellectual Property Rights

Our Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by us, our licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. These Terms permit you to use our Services for your personal, non-commercial use only.

If we provide desktop, mobile, or other applications for download, you may download a single copy to your computer or mobile device solely for your own personal, non-commercial use, provided you agree to be bound by our end user license agreement for such applications.

3. Website Content, Ownership & Third-Party Assets

Arsenal Computing may use licensed third-party content, including images from providers such as Freepik. When Arsenal Computing creates a website for a client:

  • The client is granted usage rights for the final website as a whole, but does not acquire a separate license for individual third-party assets (such as Freepik images) used within the website.
  • If the client transfers the website to another provider, they are responsible for ensuring compliance with any third-party content licenses.
  • The client may not resell or distribute third-party assets separately from the website unless they obtain their own valid licenses for such content.
  • Arsenal Computing retains ownership of all original website content created for clients unless explicitly transferred through a written agreement. Clients are granted a license to use the content for their website but may not reproduce, modify, or distribute the content for other projects without prior written consent.
  • Unauthorized use of website content outside of the agreed-upon project scope may result in legal action.
  • If a client modifies content significantly, Arsenal Computing is not responsible for any resulting claims or liabilities.
  • Any content provided by the client for use on their website remains their intellectual property, and Arsenal Computing does not claim ownership over such materials.

4. User Contributions

Our Services may contain interactive features that allow users to post content. You are responsible for any content you submit and must have the necessary rights to grant us a license to use that content. We are not responsible for content posted by users.

5. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. YOUR USE OF OUR SERVICES IS AT YOUR OWN RISK.

6. Limitation of Liability

IN NO EVENT SHALL ARSENAL COMPUTING, ITS AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES.

7. Indemnification

You agree to indemnify and hold Arsenal Computing harmless from any claims or liabilities arising from your violation of these Terms or your use of our Services.

8. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of Connecticut. Any legal action shall be brought exclusively in the courts located in Hartford, Connecticut.

9. Changes to these Terms

We may update these Terms at any time. Continued use of our Services after changes means you accept the revised Terms.
